Preston multi-million pound business boss’ £250,000 HMRC bill and six-year ban

A man who ran a multi-million pound firm but failed to keep proper accounts has been banned as from running businesses for six years.

Ashley Kelly oversaw millions of pounds going in and out of Blue Hulk Associates Ltd but either could or did not provide any records to the liquidator when the business went bust.

Kelly, of Riversleigh Way, Preston, also failed to ensure the companies paid its PAYE and National Insurance liabilities, leaving an outstanding bill of more than £250,000.

The company was set up in June 2017 and according to Companies House it was involved in plumbing, heat and air-conditioning installation. Just two years later, it was wound up in court the request of HMRC.

The Government’s Insolvency Service has now taken action against Kelly, 32, as it hit him with a six year disqualification from running businesses.

According to it’s investigation, liquidators were unable to verify that deposits of more than £4.4million paid into the company bank account from January 2018 were received for the benefit of the business.

The poor accounting also meant that they were unable to verify that an almost identical amount paid out of the account in that period was for the company’s benefit.

The Insolvency Service’s finding added that they could not verify that “in particular £553,917 paid to Logistic and Supply, £448,450 paid to JS Stones Sales, £81,055 paid to Rhino Consulting, £73,481 paid to Staunch City, £45,724 paid to Charles Okotie and £40,215 paid to Invincible Logs were made in respect of legitimate business expenditure”.

It goes onto state that Blue Hulk submitted a monthly PAYE/NIC return of £13,958.40 for April 2018 which was due to be paid by 22 May 2018. No payments were made in respect of this return and Blue Hulk was therefore in arrears for PAYE/NIC from 22 May 2018.

Blue Hulk then submitted further monthly PAYE/NIC returns until April 2019 totalling £227,973.92, during which time £4.45million was credited to the company bank account and £4.19million was debited.

Again, no payments were made to HMRC in relation to Blue Hulks PAYE/NIC liabilities and in the period May 22, 2018 to April 5, 2019, Blue Hulks PAYE/NIC liability increased by £227k from around £14k to £242k

Including late penalties, tax, VAT and a surcharge, HMRC has submitted a claim in the liquidation of £258.284.67
